    Delivery-Room Failures That May Cause Oxygen Deprivation

    Filing Deadlines for Birth Injury Claims in Alabama & Georgia

    Filing deadlines depend on where the care occurred, the child’s age, and the facts surrounding discovery of the injury. Families should seek a case-specific review promptly, because statutes of repose can bar claims even when an injury wasn’t immediately understood.

    Alabama

    Under Alabama Code Section 6-5-482, a medical malpractice claim generally must be filed within two years of the act or omission, subject to limited exceptions and an outer four-year statute of repose. When a child was under age four at the time of the alleged malpractice, the statute generally allows filing until the child’s eighth birthday.

    Georgia

    Georgia law generally applies a two-year limitation period for medical malpractice claims, along with a separate statute of repose that can further limit when a claim may be filed, particularly for minors. A child injured before age five generally has until their seventh birthday to file, with the repose period not running until age ten. Because deadlines and their exceptions vary based on the child’s age and the specific facts involved, families should seek a prompt review to determine the applicable filing window.
