What Is Product Liability?

Product liability refers to the legal responsibility of manufacturers, distributors, and sellers for injuries caused by defective or unreasonably dangerous products. If a product is not reasonably safe for its intended use and causes harm, companies may be held financially responsible for resulting injuries, medical expenses, lost income, and other damages.

Types of Product Defects

There are three primary types of product defects:

Manufacturing Defect

A manufacturing defect occurs when a product is improperly assembled or produced, making it more dangerous than intended. Even if the design itself is safe, errors during production can cause serious harm, such as faulty wiring or missing bolts. 

Design Defect

A design defect exists when a product is inherently unsafe due to its design, even if it was manufactured correctly. Examples include a vehicle prone to rollovers or a children’s product with a choking hazard.

Marketing Defect (Failure to Warn)

A marketing defect or “failure to warn” occurs when a company fails to provide adequate instructions or warnings about known risks. This may include missing safety labels, unclear dosage instructions, or failure to disclose dangerous side effects.
