How Does The Federal Tort Claims Act Work?

  • You sustained an injury in a government building;
  • You suffered an injury on public property;
  • You were harmed by Veterans Administration health care provider; or
  • You were injured in an accident caused by a government employee.

Not all injuries in the above examples will necessarily require you to file a claim under the FTCA, as there are additional elements to consider. For this reason, it is important to have an attorney evaluate your case.

Required Elements of a FTCA Claim 

Does your case fall under the FTCA? Generally speaking, the following are the elements that you will need to prove in order to file an administrative claim and to sue the federal government for your injuries:

  • Federal government employee caused your injury;
  • Federal government employee was acting negligently at the time of the injury;
  • Your injury resulted from the federal government employee’s negligence; and
  • Federal government employee’s actions were within the scope of their job duties as a federal government employee at the time of the injury.

To seek compensation, you will first need to file an administrative claim within two years from the date of your injury. The government will either extend a settlement offer or deny your claim. From that point, you will have six months to file a lawsuit.

Common Types of Claims Under the FTCA 

What are some of the common types of claims that must be filed under the FTCA? The following are examples of claims that could be filed under the FTCA:

  • VA doctor negligence that causes a patient injury, such as a misdiagnosis by a VA physician or a medication error made by a VA health care provider;
  • Pedestrian or vehicle occupant injured by a collision involving a postal truck on duty; or
  • Slip and fall in a federal government building.
